Vancouver Sculpture Biennale

AUCTION INFORMATION

The sculptures listed in this catalogue, as may be amended by the sale room notice or announcement, are for sale by the Vancouver International Sculpture Biennale/Biennale Internationale de la Sculpture de Vancouver (for all future reference referred to as the Vancouver International Sculpture Biennale) for its own account. The Vancouver International Sculpture Biennale is a not-for-profit organization and has a registered charitable status number. These Terms and Conditions of Sale constitute the summary terms and conditions on which all of the sculptures and maquettes will be offered for sale. For a complete and final set of terms and conditions please refer to the gala auction website, www.vancouverbiennale.com/auction. Printed copies will be available upon request. All changes and updates will be posted not less than 24-hours before the start of the Auction. Printed copies of the final and binding set of conditions of purchase and sale also will be available on request at the Auction for Gala Attendees.

Registration

To bid in person will require a Gala ticket. If you are bidding in person, bidding at the auction will be by paddle only. Buyers are advised to register no later than 5pm local Vancouver time on Thursday March 1st, 2007. To pre-register, please refer to the auction website or call +1.604.682.1289 or email info@vancouverbiennale.com. Credit card and bank information will be required and validated to register.

Gala Attendees

If you are bidding in person, bidding at the auction will be by paddle only. Pre-registration is advised to expedite your arrival at the Gala. Please telephone (604) 682-1289. Buyers who have pre-registered must still collect their paddles in order to bid. Credit card and account information will be required and validated to register.

Absentee Bids

Prospective buyers are advised to attend the auction. However, absentee bids will be accepted and executed if received in advance of the auction by mail or fax to the office of the Vancouver International Sculpture Biennale no later than 5pm local Vancouver time on Wednesday February 28th 2007. Absentee bidders are kindly requested to complete the absentee bidding form at the back of the catalogue. Credit card and account information will be required and validated to register.

Christie's and the Vancouver International Sculpture Biennale will not be responsible for failing to execute such bids or for errors relating to the execution of such bids or following any other instructions of any absentee bidder.

At the written request of the Absentee bidder, Christie's will limit overall expenditures in the auction to a predetermined limit communicated to Christie's by the bidder. If such a request is made, Christie's will stop bidding on new lots as soon as the bidder reaches the predetermined limit in successful bids. If the Vancouver International Sculpture Biennale has received bids on a lot for identical amounts and at auction those bids are the highest bids for that lot, the lot shall be knocked down to (a.) first, an identical bid from a Gala attendee, or if no Gala Attendee bid matches or exceeds the Absentee bids then (b.) to the Absentee Bidder whose duly completed form was more by the first bid received in writing.

Telephone Bidding

If you cannot attend the auction, you may bid by telephone during the auction by completing the absentee bid form. Your request for a reservation by telephone bidding must be received by the Vancouver International Sculpture Biennale no later than 5pm local Vancouver time on Wednesday February 28th 2007. A representative of the auction will acknowledge your request for telephone bidding. Credit card and account information will be required and validated.
ANY FAILURE TO EXECUTE BIDS OR ANY MISTAKE IN DOING SO CANNOT BE THE RESPONSIBILITY OF CHRISTIE'S OR ITS STAFF, OR OF THE VANCOUVER INTERNATIONAL SCULPTURE BIENNALE OR ITS STAFF OR ITS MEMBERS.

Limitations & Conditions of Purchase & Sale

EACH SCULPTURE AND MAQUETTE WILL BE PURCHASED AND SOLD AT THE TIME OF CLOSING BIDS ON EACH LOT. THE BID PRICE IS DUE AND PAYABLE BY EACH PURCHASER IN FULL AT THE TIME OF PURCHASE AND SALE FOR ALL LOTS SELLING FOR LESS THAN CDN $ 30,000.00. FOR ALL ITEMS SELLING FOR MORE THAN CDN $15,000.00, A NON-REFUNDABLE DEPOSIT OF NOT LESS THAN TEN PERCENT (10%) OF THE SELLING PRICE IS DUE AND PAYABLE AT THE TIME OF SALE, AND THE BALANCE DUE WITHIN FIFTEEN (15) DAYS. SUCH A DEPOSIT WILL BE FORFEIT AS PARTIAL DAMAGE IF THE BALANCE IS NOT PAID OR IN THE CONDUCT OF THE SALE OR OF THE SCULPTURES AND MAQUETTES.

RISK PASSES TO THE PURCHASER AT THE TIME OF PURCHASE AND SALE. PLEASE SEND A COPY OF THE BIDDING FORM TO YOUR INSURERS IN ADVANCE. IN EXCEPTIONAL CIRCUMSTANCES AND WHEN REQUESTED IN WRITING, THE VANCOUVER INTERNATIONAL SCULPTURE BIENNALE MAY, IN ITS SOLE DISCRETION AND FOR GOOD CONSIDERATION, AGREE TO ALTERNATIVE ARRANGEMENTS. BID PRICES ARE NET OF, AND SALES ARE EXCLUSIVE OF, APPLICABLE TAXES, SHIPPING, INSURANCE AND RELATED COSTS.

THIS IS A NOT-FOR-PROFIT AUCTION. THE VANCOUVER INTERNATIONAL SCULPTURE BIENNALE AND CHRISTIE'S SELL ALL SCULPTURES AND MAQUETTES EXACTLY AS THEY ARE AND WHERE THEY ARE, AND GIVE NO WARRANTY OF ANY KIND AS TO CONDITION, FITNESS, ACCESS OR HISTORY. EACH BIDDER AND EACH PURCHASER FURTHER AGREES TO HOLD HARMLESS THE VANCOUVER SCULPTURE BIENNALE AND CHRISTIE'S, AND THEIR DIRECTORS, EMPLOYEES, CONTRACTORS, VOLUNTEERS, AND AGENTS, FROM ANY CLAIM RELATED TO THE CONDUCT OF THE AUCTION OR SALES, AND FOR ANY ACT OR OMISSION OF THESE PARTIES. THE VANCOUVER INTERNATIONAL SCULPTURE BIENNALE AND CHRISTIE'S EXPRESSLY EXCLUDE ALL IMPLIED WARRANTIES OR CONDITIONS RELATED TO THE MAQUETTES, SCULPTURES, AND AUCTION.

Not-for-Profit Auction: No Buyer's Premium

Christie's is conducting the auction on behalf of the Vancouver International Sculpture Biennale; no proceeds will go to Christie's auction house. Proceeds will be distributed in the following manner: to pay the artists, and then to pay all financial obligations of the Auction. The residual amounts will be applied to sustain the Vancouver International Sculpture Biennale, including a portion towards the purchase of legacy sculpture or the development of an endowment fund, such distribution to be in the discretion of the Vancouver InternationalSculpture Biennale.

Bidding Procedures

The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to reject any bid and to advance the bidding at his absolute discretion and, in the event of any dispute between the bidders, to determine the successful bidder or to re-offer and re-sell the item in dispute. Should there be any dispute after the sale; the Christie's record of final sale shall be conclusive.

The bidding increments in this auction will be determined by the auctioneer.

Information for Prospective Bidders

If this is your first time at an auction, the procedure is quite straightforward. After registering in person, you will be given a numbered paddle. To bid, simply raise your paddle until the bidding reaches your spending limit.

If you have any questions about bidding, a member of the Vancouver International Sculpture Biennale and Christie's team will be in attendance at the auction.

Bidding generally opens below the low estimate and advances in increments of up to 10%, subject to the auctioneer's discretion.

Reserves

The reserve price is the confidential minimum price the Vancouver International Sculpture Biennale will accept. The Vancouver International Sculpture Biennale also reserves the right to not accept any bid on reasonable grounds.

Buy-In (bought in)

This term is used to convey that bidding has not met the pre-established reserve, hence, the art work cannot, and has not, been sold.

Shipping

It is at the sole discretion of the purchaser to decide how and with whom to ship their piece. All costs and risks related to shipping, including the de-installation and preparation for shipping, are the sole responsibility of the purchaser, including all export permits, documentation, and insurance. It is the sole discretion of the purchaser to decide and make arrangements for how and with whom to ship purchased sculptures and maquettes. All purchases must be removed before April 30th, 2007, in the absence of alternative agreements in writing with affected parties (generally the Vancouver International Sculpture Biennale and the City of Vancouver), and such parties may in their sole discretion refuse any and all such requests and in no circumstances will any such alternative agreement diminish the limitations and exclusions of these Terms and Conditions.

The packing company, which the purchaser has chosen or agreed to ship with, will provide customs/export documentation or insurance required. Please advise your insurance company accordingly.

Tax Exemptions

All bid prices are exclusive of applicable goods and services taxes, and exporting and other regulator levies. Each purchaser is responsible for, and must pay all applicable taxes, or provide evidence of exceptions to the satisfaction of the Vancouver International Sculpture Biennale. Back to Top
